WHAT’S ON THE POSTER?

Again, as it is Turkey Week, no hearings or meetings are scheduled on the Hill on Tuesday. There have been rumors of possible plans to tackle the Obamacare subsidy issue, with a possible White House plan involving a scaled-back expansion rumored to have been floated, but then reportedly withdrawn. As part of the deal to end the Schumer shutdown, Senate Majority Leader John Thune (R-SD) promised a vote on the subsidies by Dec. 12. Here’s what Punchbowl has to say about the current state of affairs:
There has always been It’s clearly possible that Thune’s voting promise will simply become a messaging exercise for Democrats whereby they all vote for a clean extension of the subsidies, which falls well short of 60 votes and everyone moves on with their lives.
The alternative, of course, this is a compromise product that extends Obamacare subsidies in one form or another. A key unknown variable here is what exactly the coalition that wins 60 votes will look like. Is it almost all Democrats and a handful of Republicans? Or vice versa? Or is it more like 30 to 40 senators from each party?
If the starting point is a bill supported by Trump, the vast majority of the Republican Senate Conference will likely support it. The question is whether there are enough Democrats to provide more than 60 votes. Last week, top Senate Democrats publicly cast doubt on the prospects for an Obamacare expansion, while many progressives are unlikely to vote for anything short of a clean expansion.
It will be a similar calculus in the House, where Johnson would likely need a good chunk of Democratic votes to compensate for Republicans who will never vote for an Obamacare extension, even under Trump’s leadership.
This dynamic would be tricky territory for Johnson. Republican House speakers are sensitive to criticism that they rely on Democrats to pass legislation. Johnson also likes to say that his job is to build consensus among Republicans.
Add to that the recognition that Speaker Mike Johnson’s (LA-04) slim margin is likely to become even thinner between Rep. Marjorie Taylor Greene (GA-14) who will announce her resignation in January and Rep. Don Bacon (NE-02) who is rumored to be threatening to resign due to his dissatisfaction with the proposed Russia-Ukraine peace plan. The special election to replace Republican Mark Green in TN-07 is next Tuesday, and Republican Matt Van Epps is expected to have a decent lead over his Democratic (and apparently crazy) challenger Aftyn Behn, but it’s never wise to count chickens before they hatch. Johnson has pulled a few rabbits out of his hat during his tenure – he’ll likely need a few more to navigate the coming weeks.
What’s new at the White House
On Tuesday at noon, President Trump and First Lady Melania will participate in the annual Turkey Pardon Ceremony in the Rose Garden. In the evening, they will leave the White House and head to Mar-a-Lago, where they will spend the Thanksgiving weekend.

Some court decisions worth mentioning on Monday:
- ✅ Harper v. Bessent (Removal of Independent Agency Officers – National Board of Credit Union Trustees) — the Supreme Court DENIES petitioners’ petition for certiorari.
- ❌ Democracy Forward Foundation v. DOJ (FOIA/Records Preservation Request Regarding Handling of Epstein Cases) — Judge Tanya Chutkan (DC) GRANTS in part and DENIES in part plaintiffs’ motion for summary judgment. Originally, I intended to rate this one as a ↔️ since the decision is a partial permit and a partial denial, but the decision directs the administration to “expedite processing of Democracy Forward’s July 25 and 28 FOIA requests, except with respect to the overly broad search terms “whistleblower” and “flight logs.” In other words, overall, it’s a victory for the plaintiffs.
The big news, of course, was the dismissal of the indictments against James Comey and Letitia James on the grounds that the appointment of Lindsey Halligan as U.S. Attorney in the Eastern District of Virginia was improper. White House press secretary Karoline Leavitt said Monday afternoon that the administration would appeal the decision.

Score another SCOTUS victory for the Trump administration
We also saw the DOJ request (again) permission to unseal grand jury transcripts and exhibits in the Jeffrey Epstein and Ghislaine Maxwell cases. We will also keep an eye on these decisions.
MORNING REFLECTION
As Bob Hoge noted in his follow-up article regarding the dismissal of the indictment against James Comey, the former FBI director released another holier-than-thou video in reaction to the dismissal.
James Comey issues statement celebrating activist court’s dismissal of charges against him WITHOUT PREJUDICE.
All the Democrats and RINOs have are scams, smoke and mirrors.
Comey has not been exonerated and the case is not over.

The whole two minutes are boring, but this is the part that got me:
“This case matters to me personally, obviously, but it matters most because a message needs to be sent that the President of the United States cannot use the Justice Department to target his political enemies. No matter your politics, you must see this as fundamentally un-American and a threat to the rule of law that keeps us all free.”
That’s right, rich coming from one of the key players in the cabal that for years has been doing just that, targeting not only Donald Trump but also Republicans and conservatives. You can’t twist the rule of law into pretzel knots and then scream when you’re served the same thing.
I would like us to return (or move forward) to a place where we can all not only agree on the importance of the principle of blind justice and not allowing the DOJ – or any element of government – to be used as a weapon against American citizens for political/partisan purposes. Sign me up.
But for Saint “8647” Comey to play uphold these ideals when he was one of the worst offenders in trampling on them is bullshit.
Save it for your next book, Jim. I will be sure not to buy it.
