A federal judge from Nashville judged on Sunday that Kilmar Abrego Garcia could be released on bond. But the decision does not mean that Greo Garcia will be able to walk freely.
The American judge Barbara Holmes of the American district court for the Middle Tennessee ordered that Greo Garcia was released as he awaits his trial for human smuggling.
In his decision, Holmes wrote that the government has not proven that Garcia Garcia was a risk of theft. However, she recognized that there is something on both parties in the court of agreement: Abrego Garcia will probably remain in detention, whether or not that he has confirmed the request of the accusation in detention.
Originally a Salvadoral who lived with his wife and children in Maryland, Abrego Garcia was expelled in March at the notorious of the Cecot prison of El Salvador despite an order from the 2019 court prohibiting his expulsion in this country because of the fear of persecution.
The 29-year-old, who has only returned recently to the United States to deal with these federal accusations, can enter immigration and customs application, or Glua, instead, according to officials.
“This suggests that the determination of the court of detention problems is hardly more than an academic exercise,” Holmes wrote in his opinion.
However, she continued to explain, the principle of the regular procedure requires that everyone accused of a federal crime has a presumption of innocence.
Prosecutors argue that Greo Garcia conspired to transport thousands of migrants without legal status from Texas across the United States between 2016-2025.
The defense indicates that the accusations must distract from the absence of regular procedure in the case of Abrego Garcia.
Another hearing is scheduled for Wednesday afternoon to set conditions for its release.
