Justice Department Files Immediate Appeal To Abortion Pill Ruling

On Friday, the Ministry of Justice filed an immediate appeal following a shocking decision of the Federal Judge of Texas to draw the approval of Miffepristone by the Food and Drug Administration, one of the two drugs used in abortion by medicines.

The Ministry of Justice called directly on the American Court of Appeal for the fifth circuit on Friday evening, just a few hours after the initial decision.

US prosecutor Merrick Garland said in a statement that the MJ “does not agree with the decision” and “will appeal the decision of the court and request a pending appeal”.

“Today’s decision reverses the expert judgment of the FDA, rendered more than two decades ago, that mifepristone is safe and effective,” wrote Garland. “The ministry will continue to defend the FDA decision.”

US District Judge Matthew Kacsmaryk ruled that the FDA approval of Miffepristone was illegal when the drug went on the market in 2000. Kacsmaryk said in his decision that the FDA “manipulated and misinterpreted” certain parts of the drug approval process in order to “say large -scale electoral lawyers”.

The decision does not take effect for seven days, allowing the Doj’s call to play.

Alliance Defending Freedom, a conservative Christian legal group, filed the complaint in November before a federal court in Amarillo, Texas, arguing that the FDA was going beyond its authority 22 years ago and accelerated the approval of mifepristone. But the abortion by drugs, the combination of mifepristone and another medication called Misoprostol, has a very safe and effective assessment during the 20 years and more approved by the FDA. On Friday, a federal judge of the state of Washington made a competing decision, which prevents the FDA from drawing the approval of Miffepristone in 17 states and the District of Columbia. Garland declared in his declaration on Friday evening that the Doj also examined the decision of the state judge of Washington.

Vice-president Kamala Harris said in a press release on Friday evening that the decision is an “unprecedented decision”.

“In simple terms: this decision undermines the FDA’s ability to approve safe and effective drugs – from chemotherapy drugs to asthma medicine, including blood pressure pills, insulin – depending on science, not politics,” she wrote.

“Each person in our country should have the right to access safe and effective drugs that have been approved by the FDA. Faced with attacks against the right of a woman to access an abortion, our administration will continue to fight to protect freedom of reproduction and the ability of all Americans to make health care decisions with her free doctors against political interference. ”
