Burn the American Flag, Go to Jail – RedState
I am not a lawyer, but I have never fully understood how the American flag is a problem of “freedom of expression”. It is not the same to give a flag on fire as to give your opinion or write an article – it is an action. If I took my bed sheet and lit it on fire on Fifth Avenue, I’m almost sure that a cop would stop shortly.
Donald Trump is certainly not a fan of burning flags and on Monday, he signed an executive decree prohibiting practice. Entitled Burning of the American Flag, the order promises to restore the “holiness” of stars and stripes:
My administration will act to restore respect and sacredness to the American flag and pursue those who encourage violence or who otherwise violate our laws while desecrating this symbol of our country, to the fullest measure per virtue of any available authority.
The order noted that those who “encourage violence or who violate our laws” will be prosecuted otherwise.

The ordinance orders the Ministry of Justice to continue the people who “profane” the flag, as well as the detention and expulsion of immigrants accused of burning of the flag.
“If you burn a flag, you get a year in prison, no early outings, nothing,” Trump said in the oval office.
The order will certainly be disputed by hateful leftists in America. In 1989, the Supreme Court ruled that the flag burning was a protected discourse. Trump recognized this question in his order:
Notwithstanding the decisions of the Supreme Court on the protections of the first amendment, the Court never judged that the desecration of the American flag carried out in a manner likely to encourage action without imminent law or which is an equivalent action to “fight against words” is protected by the Constitution. See Texas c. Johnson491 US 397, 408-10 (1989).

The tweet continues:

Trump has long been critical of the flag burning, which gained popularity during the demonstrations of the Vietnam War:
Since the start of his career in politics, Trump has argued for imposing legal sanctions on the demonstrators who destroy the American flag despite the previous decision of the Supreme Court.
In the past, the president has called to eliminate citizenship from naturalized American citizens who burn the flag and pleaded for a prison sentence as punishment.
Trump during the 2024 campaign season, even launched the idea of introducing a constitutional amendment to prohibit the burning of the flag as a protected form of protest.
In the midst of anti-glossy demonstrations at the earliest this year, Trump called to throw demonstrators in prison for a year to set fire to the flag.
“These are animals, but they proudly carry the flags of other countries. They do not wear the American flag, ‘said Trump to a crowd of soldiers in Fort Bragg.
“They just burn it. Have you seen a lot of burnt flags? “”
We do not know if this order will survive the courts, but Trump has just clearly indicated where he stands on the issue.
