Full Speed Ahead. Department of Defense Will Appoint 600 Military Lawyers As Temporary Immigration Judges – RedState
The Ministry of Defense ordered that up to 600 military lawyers be awarded as temporary immigration judges. The Ministry of Defense travels the ranks of the lawyers of the active component, the National Guard and the reserves to connect holes to the ability of the administration to jump through the necessary legal hoops before the illegal expulsion.
The first 150 lawyers are supposed to appear at the Ministry of Justice the week of September 8, probably for orientation training. They will be detailed at the Ministry of Internal Security for 179 days, to avoid paying them for a permanent decision, and this detail can be renewed.
Military lawyers can replace immigration judges because these posts are article II, that is to say executive power, and not judicial appointments.
There are currently about 600 immigration judges. More than 100 have been dismissed or left voluntarily after the Trump administration took office, because they decided to take measures rather than simply playing the rope with the cases allocated to them. There are currently 3.45 million cases of pending immigration. 466,942 new cases were received during the 201025 and 810,417 case was closed. This is compared to only 19,792 closed cases during fiscal year 21, when there were more judges than today.

[Jennifer Peyton, who was a supervising immigration judge until she was dropkicked in July] doubted that military lawyers could master the complexities of immigration law without this rigorous process. She also said that it was not clear how they would manage the hundreds, or sometimes thousands of cases, on the file of a Chicago immigration judge each year.“Six months is barely enough time to start understanding the information pipe and training,” she said.
Peyton was also concerned that Trump’s decision did not provide more administrative workers, including translators, on which judges count to make decisions. The stakes, she said, were life or death for people who would come before the new judges.
“None of this makes sense unless you are intentionally trying to weaken the immigration courts,” said Peyton.

But the use of military lawyers has raised concerns, said another person familiar with planning – speaking like the others under the cover of anonymity for fear of reprisals – that these officers would have no experience in legal immigration procedures or can receive insufficient training for complicated and potentially general deportation hearings.

A number of lawyers called in active service, and most of the 600 will be reserve officers, will practice immigration law. Most cases will be illegal illegal excess cases or simple illegal visa. Overall, I think it is difficult to criticize this idea of good faith. I understand that this thwarts the conceptions of these immigration judges who oppose Trump policies and want to delicate the works, but it is a characteristic of ensuring that the general officers of the military judge serve as temporary immigration judges.
