Peter Navarro Sues Justice Department Amid Ongoing Dispute

Peter Navarro, the main advisor to the President of Commerce and the Manufacturing of President Donald Trump, intensified his dispute with the United States Ministry of Justice (DoJ) by fileing a complaint for the accusation against him for contempt of the Congress linked to the Committee of January 6.

The Ministry of Justice disowned its role in its accusation act, which led to a four -month stay in a minimum security prison, but Navarro argued that the ministry could not disentangle the accusation which led to its imprisonment.

Nowsweek Contacted the DOJ by e-mail outside normal opening hours Sunday evening to comment.

Why it matters

Navarro refused to appear before the restricted committee of the Chamber to investigate the January 6 attack on the American Capitol, known as the Committee of January 6. He and Steve Bannon were each detained in defiance of the congress and were imprisoned for four months after the Doj continued them.

The former Trump advisers, Mark Meadows and Dan Scavino, were also detained in criminal outrage at the Congress, but the Doj did not prosecute them.

Navarro tried to appeal to his case before the Supreme Court, but the judges refused to hear his case.

The DoJ has also abandoned a file against Navarro, in which it is accused of having used an unofficial messaging account for the government’s work and to wrongly keep presidential files during the first Trump administration.

What to know

Navarro argued that his status as the principal presidential advisor of Trump during the first administration should have protected him from the accusations of outrage – mainly because the president had invoked the executive privilege of the case, which, according to Navarro, made him impossible to testify before the committee.

However, the courts of appeal determined that Navarro never invoked this privilege before the accusation of outrage.

The DoJ said that he no longer understood the arguments that led to the conviction of Navarro, but Navarro is eager to maintain the department involved in order to determine “the separation of the powers that this case presents”.

In a 13-page thesis filed with the United States Court of Appeal for the District of Columbia, Navarro and its lawyers say the sudden overthrow, for which the DoJ only said that it had “determined that it was no longer taking the same position as the previous administration” on the case, is unacceptable.

The file affirms that the case has “extraordinary constitutional implications” on the separation of powers and if a White House advisor can be prosecuted criminally for having resisted the congress.

“The Ministry of Justice should not be authorized to disavow, without explanation or recognition of its reasons, the positions he held in this case for more than three years,” said the file.

“Without such an explanation, the court and the appellant must speculate if the decision is based for legal grounds in principle or for other considerations, less appropriate,” according to the lawyers of Navarro and its lawyers.

“For these reasons, the court should reject the ministry’s request to strike his dissertation unless he ensures a complete and particular declaration of his reasons to abandon his previously held position,” continued the file.

“If the court nevertheless grants the request, he should first force the ministry to state these reasons on the file before considering appointing a Curiae AMICUS as a substitute ministry advisor.”
