Google admits the open web is in ‘rapid decline’

Google:
Finally, while the applicants continue to advance essentially the same disinvestment remedies they noticed in their complaint filed in January 2023, the world continued to turn. The complainants presented appeals as if the trial, the decision to liability for the court and the discovery of appeals have never occurred – and also as if the incredibly dynamic technological ecosystem had stopped while these legal proceedings were continuing.
But there have been many changes: AI reshapes advertising technology at all levels; Undo -open web display advertising formats such as connected television and retail media explode in popularity; And Google competitors direct their investments towards these new areas of growth. The fact is that today, the open web is already in rapid decline and that the proposal to deactivate complainants would only accelerate this decline, harming publishers who are currently counting on advertising revenues of the open display. As the law clearly shows, the last thing that a court should do is to intervene to reshape an industry that is already being reshaped by market forces.
