Another Day Ending in Y, Another TRO Against Trump—This Time on Firing Fed Governor Lisa Cook – RedState

It is again as already seen – almost every day. Trump takes on an executive action, the leftist Sue, then a district judge intervenes and tells the president that he cannot do what he proposed.





As we reported, Trump dismissed the governor of the Federal Reserve Lisa Cook in August due – the “cause” being that it is under investigation by the DoJ for several cases of alleged mortgage fraud – but a lawyer appointed by Biden actually declared on Tuesday evening, “no, no, you cannot do it.”

Tuesday evening, a federal judge prevented President Donald Trump from dismissing the governor of the Federal Reserve, Lisa Cook, while his trial contesting his dismissal takes place before the court.

The program by judge JIA COBB of a temporary prohibition order in the case intervened almost two weeks after Cook continued Trump to prevent him from withdrawing it from the Central Bank.

Trump said on August 25 that he dismissed Cook due to suggestions by the director of the federal housing agency, Bill Pulte, that she had committed mortgage fraud in the context of documents she signed for two residential properties she has in Georgia and Michigan.

has proven that this case is open and closed. Trump is clearly justified to dismiss her.

The judge decided that “the public’s interest in the independence of the federal reserve” had priority on the president’s authority:

“The public interest in the independence of the federal reserve weighs in favor of the reintegration of Cook,” COBB wrote in an opinion on his decision on Tuesday.

The COBB order prohibits the president of the Fed, Jerome Powell, and the Council of Governors “to carry out any way” Cook’s dismissal due to the order of Trump.

As I wrote previously, the definition of “cause” in the case of the Fed is troubled:

The Fed acts as an independent agency, but that does not mean that the executive power has no role. According to their website, the Board of Directors is led by seven members, or “governors”, staggered by 14 years, which are appointed by the president and confirmed by the Senate. The 1913 Federal Reserve Act said that a president can dismiss a member of the Federal Reserve Board, but only “for good reason”.

The “cause” has never been defined with precision and legal experts are divided on the question of whether Trump’s decision will survive judicial disputes.





Expect that he finds himself in front of the Supreme Court in the not too distant future. Although Trump has not behaved perfectly at the highest courtyard in the country, his history with Scotus are clearly better than the judges of the opinion district.

For the moment, however, expect to see Cook at the next meeting of the Federal Reserve Board.
