Supreme Court Appears Poised to Safeguard Girls’ Athletics – RedState


Tuesday’s arguments before the Supreme Court over the issue of allowing “transgender girls,” or as they are more commonly known, boys, on women’s sports teams were successful. Although it is difficult to make predictions, especially regarding the future, there is a lot of post-argument discussion about how things played out. Granted, this is just speculation, and the Court probably won’t rule until this summer, but there are some general indications that things may well be on the side of reason in this case. Two media outlets, the Associated Press and NPR, both seem to think that a narrow decision in favor of the two states, Idaho and West Virginia, is in store. We might note that these media are generally inclined to support the transgender agenda.
First of all, the AP:
The Supreme Court On Tuesday, he appeared poised to deal another setback to transgender people and enforce state laws banning transgender girls and women from playing on school sports teams.
The conservative majority of the Court, which has ruled on several occasions against transgender Americans over the past year, indicated during more than three hours of debate that he would rule that state bans do not violate the Constitution or the federal law known as Title IX, which prohibits sex discrimination in education.
There is a point here with which we must wrestle; first of all, this is not a “setback for transgender people.” “Transgender girls,” or more accurately boys, can still play sports the way boys always have: against other boys. But the AP, to be fair, takes note of a statement made by Justice Kavanaugh that would appear to clarify his position.
Justice Brett Kavanaugh, who coached his daughters in girls’ basketball, seemed concerned about a ruling that could undo the effects of Title IX, which has produced dramatic growth in girls’ and women’s sports. Kavanaugh called Title IX an “incredible” and “inspiring” success.
Some girls and women could lose a medal in a competition with transgender athletes, which Kavanaugh called a harm “that we cannot dismiss.”
That’s a compelling observation, and it’s one that common-sense advocates on this issue have always made. And it’s not just about medals; these are titles, trophies, awards and maybe even scholarships. This is a financial loss, which makes it a completely different situation.

Then NPR steps in, adopting a sad tone:
The Supreme Court’s conservative majority appeared inclined Tuesday to uphold laws in 27 states that ban transgender girls from participating in sports teams in publicly funded schools.
Two transgender girls, one a college student in Idaho and the other a fifth-grader in West Virginia, wanted to be on the track teams, but state law barred them from doing so. Each of them addressed the court, arguing that their respective state laws violated both the Equal Protection Clause of the Constitution and federal laws prohibiting discrimination against women in sports.
Again, NPR features several statements from the justices, including this exchange involving Justice Amy Coney Barrett:
During the debate, some members of the conservative majority appeared to want to write a narrow opinion.
“So how would your theory apply if we’re talking about 6-year-olds, where there are no differences between boys and girls in terms of athletic ability, testosterone levels, et cetera?” » asked Judge Amy Coney Barrett.
I am willing to forgive Judge Barrett for this; after all, she’s not a biologist. But there are differences between boys and girls, even at 6 years old; these differences exist from the design stage. These are facts.
The consensus seems to be that things have worked out favorably for the states. If that’s the case, then later this year the Supreme Court may well put an end to this nonsense, or it may issue a narrow decision that leaves a lot of doors open. We’ll know it when we know it. But for now, it looks like we can have some hope.
