Article 1 of the Constitution, which created Congress in the first place, given the legislative power is the only one authorized to declare war. The War Powers Resolution of 1973 further clarifies this point, requiring the president to notify Congress within 48 hours of the introduction of U.S. forces into a conflict.
But first there’s an easy loophole here exploited by Harry Truman in 1950 to send American troops to Korea – just call your plan a “police action” or a “military operation.” Anything you want, really, except an act of war. So you don’t need these whiny nerds to approve of anything!
The War Powers Resolution failed to close this gap, and Congress has yet to formally declare war since World War II. Our country has sent hundreds of thousands of troops to kill and maim in Vietnam, Iraq, Afghanistan and now Iran. But despite all the deaths, the memorials and the waving flags, none of these wars, technically, took place.
