In a decision that was only surprising that it took to be given, another militant judge came out to oppose a Trump administration policy. This time, this implies the installation of illegal detention of very debated immigrants in the Everything of Florida, the so-called Alligator Alcatraz.

This decision follows a preliminary decision that was made weeks ago, calling for a break on the new construction on the location. Now it went further.

Judge Kathleen Williams, late Thursday evening in a courtroom in Miami, made a temporary ban prescription forcing the State to refrain from calling for any additional detainee and said that in 60 days, the installation must be eliminated from all those who take place and that the process of transporting the installed infrastructure begins to take.

The prosecution was brought by environmentalists and the Miccosuki tribe in Florida, saying that the operation on the site negatively affects the protected environment of Florida everglades. The land was not allowed to install the detention center, but it used an embodied aerodrome in the west of the Dade County. One of the applicant’s lawyers pointed out how it was a centerpiece of their costume.

  • “This brutal detention center was burning a hole in the fabric of life which supports our most emblematic wetland and a whole multitude of endangered species, majestic Florida panthes with out -stricken wooden storks,” said lawyer Elise Bennett of the Center for Biological Diversity in a press release. “The judge’s order came just in time to prevent everything from collapsing.”

Williams, one appointed by Barack Obama, said that an environmental impact assessment should be carried out before installing the new structures and other operational needs. She noted that no research in advance of this type had been carried out by the defendants, although the State challenged a reference to a “preliminary ecological evaluation” which was carried out at the end of July. Although this study alluded to several species possibly endangered, the State said that the installations around the installation have been erected to protect those of the surroundings.

Following its decision, the Tro Williams orders that all new functional installations are deleted, including maintenance tents, fencing, generators and waste collection items. As expected, this decision and the Tro will be challenged, because questions about legitimacy are at stake.

Immediately after judge Williams rendered his decision of more than 80 pages, the State called on the 11th Circuit Court of Appeals.

One of the probable challenges is the legitimacy of this court’s decision on the issue. The former press secretary of Governor Desantis, Jeremy Redfern, is now director of communications for the Attorney General of Florida James Uthmeier. Redfern notes that Williams operates in the incorrect judicial district on questions involving the installation.

This case which he referenced was brought by the ACLU concerning the legal rights of persons detained in the establishment. This prosecution was rejected earlier this week, because the court is the bad place of their business. The state of Florida made a similar argument in the Alligator Alcatraz costume, but which had been agitated by judge Williams.

The nuances in this case will be interesting to watch play, and for the moment, we have at least two months to see where it is going. Meanwhile, Governor Desantis has already set in motion the construction of a second installation of immigrant detention, the latter in northern Florida. Thus, even if the opponents manage to win and ensure that Alligator Alcatraz is closed, the attempt to restrict these facilities will not succeed.
