Another Obama Judge Steps in to Save Illegal ‘Maryland Man’ As Human Smuggling Trial Is Axed – RedState

Gird your loins, my friends, because the seemingly endless story of “Maryland Man” Kilmar Abrego Garcia, an illegal immigrant from El Salvador with a highly questionable past, has just taken a new twist. Tennessee District Judge Waverly Crenshaw, Jr., an Obama appointee, has dismissed Abrego Garcia’s human trafficking trial and will instead hold a hearing to determine whether, in Susie Moore’s phrase, St. Kilmar is being prosecuted “vindictively.”

Crenshaw’s move follows Maryland District Court Judge Paula Xinis’ decision Monday to extend the temporary restraining order she also issued that blocks the Trump administration from taking the illegal alien into custody. (By the way, Paula Xinis is also an Obama appointee.)

Kilmar Abrego Garcia was to be tried at the end of January in Tennessee for human trafficking. These charges stemmed from a traffic stop in 2022 in which he was driving the car of a convicted human smuggler and, strangely, eight people were locked in the car; These individuals were also thought to be illegal immigrants because none of them had any papers on them. Fox News Bill Melugin obtained the video from the Tennessee Highway Patrol. It shows police confronting Abrego-Garcia after he was arrested while driving the car of a convicted human smuggler. In the vehicle were eight other people, none of whom seemed to have any real connection to him. He was also carrying $1,400 in cash, which officers suspected was his payment.

Pretty suspicious, especially for a guy who allegedly beat his wife and has ties to the notoriously violent MS-13 gang,

However, Judge Crenshaw has now ended the human trafficking trial and will instead hold an evidentiary hearing on January 28 to determine whether the illegal alien is the victim of vindictive prosecution, having already determined that Abrego Garcia made a at first sight display of vindictiveness.

In his ruling, the judge said evidence provided by the defense had long tipped the scales in Abrego Garcia’s favor — at least on the due process question of whether the prosecution was vindictive.

Crenshaw wrote: “The burden-shifting framework controls the Court’s analysis. Specifically, once a defendant establishes a prima facie case of vindictiveness, “a presumption arises in favor of the defendant.” The Court has already found that Abrego has made such a showing, entitling him to discovery and an evidentiary hearing on why the government is pursuing him.”

Meanwhile, it seems St. Kilmar is very much enjoying his freedom — not to mention the perks that come with being the Democratic Party’s favorite illegal — and is embarking on a career as a TikToker. In one video, he is seen speaking the lyrics to what appears to be a Christian song in Spanish.

We’ll never be free of this guy, will we? After witnessing the hero’s welcome he and his wife received outside Paula Xinis’ courtroom last week, I was struck by the idea that the two men would soon get a political makeover — think Ozempic, Botox — and begin touring the country as Democratic Party surrogates.
