Officers found guilty in Tyre Nicholas case will have new trial

A federal judge of Tennessee ordered a new trial for three former police officers from Memphis who were sentenced for accusations linked to the deadly blow of nichols in 2023.
Judge Sheryl Lipman cited the concerns of bias after the judge who chaired the initial federal trial would have suggested that one of the accused was a member of a gang.
Nichols, 29, was pulverized, struck, kicked and punches during a traffic stop for alleged reckless driving in 2023. He died three days later.
Tadarrius Bean, Demetrius Haley and Justin Smith, JR were all found guilty of the witness, but were acquitted from the most serious accusation – that they had violated the civil rights of Mr. Nichols by causing his death.
The mortal strokes of nichols aroused indignation in the United States and led to demonstrations nationally against police brutality.
Judge Sheryl Lipman resumed the federal affair in June after the district judge Mark S Norris, who had chaired the case and the trial, challenged the case.
Judge Norris would have said that the Memphis police department had been “infiltrated at the top with gang members”, according to court documents and the judicial order quoted by the American media.
He would have commented after one of his employees was shot in a car car. The incident occurred five days after Bean, Haley and Smith were found guilty and were made as they expressed frustration in the face of the police investigation on the shooting.
Two other officers – Emmitt Martin III and Desmond Mills JR – both pleaded guilty of their involvement in the death of Mr. Nichols.
None of the five men were condemned.
Earlier this year, Bean, Haley and Smith, JR were acquitted state accusations after a jury judged them not guilty of accusations, including second degree murder, serious assault, aggravated abductions, official fault and official oppression.
This case is distinct from their federal convictions, which have long prison terms.
