Jonathan Turley Explains How Latest Court Ruling Could Send Deportations To ‘Slow Crawl’

Jonathan Turley, a law professor at George Washington University, said Thursday that a federal judge’s ruling could slow evictions if upheld on appeal.
U.S. District Judge Beryl Howell of the District of Columbia, an Obama appointee, ruled that U.S. Immigration and Customs Enforcement (ICE) cannot arrest illegal immigrants without “probable cause” and ordered that ICE agents who make arrests must document the facts leading to the arrests, WJLA reported. Turley told “Fox and Friends” guest co-host Kayleigh McEnany that the decision puts “handcuffs” on ICE. “It really reflects the problem that they’re facing,” Turley said. “The Biden administration opened the southern border and let millions of people through and people like [former Secretary of Homeland Security Alejandro] Mayorkas said: “Well, we’re doing everything we can. “We now know that was a lie, because the Trump administration closed the southern border within weeks, using the same authority as Mayorkas and Biden.”

“But once these millions arrived in the country, there were many in Congress who said, well, we don’t want to facilitate their deportation,” Turley continued. “And so what ICE and the administration are looking at is millions of people that they would now be required to get individual warrants for and that would just reduce that to a slow progression as they try to regain ground from what was lost under the Biden administration.” »
The Border Patrol has encountered millions of illegal immigrants under the Biden administration, according to figures released by U.S. Customs and Border Protection (CBP). Upon taking office on January 20, President Donald Trump issued several executive orders to combat illegal immigration, including designating the Mexican drug cartels, the Venezuelan prison gang Tren de Aragua, and the Salvadoran prison gang MS-13 as foreign terrorist organizations.
“Realistically, the Supreme Court is going to have to look at these standards,” Turley told McEnany. “The administration says we should only have to demonstrate reasonable suspicion that someone is in this country illegally, we think these people are at risk of flight. This judge has good faith reasons why she said, you know, I think the law says otherwise.”
