A federal judge prevented President Donald Trump’s plan on Saturday from sending the national guard troops to Portland, judging that the deployment would violate the constitutional limits of military participation in the national police.

US District Judge Karin Immergut, a Trump candidate, made a temporary ban prescription preventing the administration from sending hundreds of troops to Oregon City, New York Post reported. The judge noted that the evaluation of the situation by Trump did not correspond to reality.

“The president’s determination was simply not attached to the facts,” wrote Immergut in his decision.

The judge said protests outside a South Portland immigration establishment had remained mainly peaceful before Trump’s order. “Overall, the demonstrations were small and without incident,” said the post. Trump announced last week that he would deploy 200 troops of the National Guard to support the immigration authorities against what he called “national terrorists”. He then ordered the Pete Hegseth war secretary to send “all the necessary troops”.

The White House quickly challenged the decision. “President Trump has exercised his legitimate power to protect federal assets and staff in Portland following violent riots and attacks against the police – we plan to be justified by a superior court,” said spokesperson Abigail Jackson.

The prohibition order expires in 14 days.

Federal immigration officials said the ICE detention center has faced attacks for more than 100 consecutive nights with a minimum of local police aid.

On Saturday, federal agents fired tear gas, maca and peppery gas to hundreds of demonstrators who went to the establishment. Trump also ordered his administration on Friday to identify federal funds to cut from Portland as punishment for current disorders.

“We will not finance the states that authorize anarchy,” said the White House press secretary Karoline Leavitt.
