Letitia ‘No One Is Above the Law’ James Sued for Threatening School Board Members Over Trans Athletes – RedState

Letitia James, the Trump-obsessed New York State Attorney General, likes to say, “No one is above the law.” Almost her entire campaign was based on the theme of “Get Trump for Everything,” and she filed a legally dubious real estate fraud lawsuit against him when there were no victims, and the banks involved all said they would continue to do business with him. The fine imposed on the Trump Organization by the clearly biased judge, Arthur Engoron, amounting to nearly half a billion dollars, was so excessive that an appeals court threw it out in August.

This is how Letitia James operates, skating on the edge of ethical conduct and intimidating those she perceives as ideological enemies.

So it should come as no surprise that an Empire State school board president is suing the AG for allegedly threatening to remove board members who dared to deviate from the (crazy) progressive line on men in women’s sports.

The alleged threats came in a ‘guidance letter’ [from James] which warned against removing any school board member who uses the wrong pronoun for a trans person, or allowing students to speak publicly at school board meetings about their fears and discomfort with trans student athletes using the wrong locker room for their biological sex.

A plaintiff in the lawsuit, Massapequa Union Free School District board president Kerry Wachter, claimed she was told that James’ office asked her to mute and remove any board meeting speakers who expressed views opposing trans athletes in locker rooms and girls’ sports.

Wachter says James’ intimidation tactics are aimed at silencing her and others:

“They’re saying if we allow this discussion at our board meetings, she can come and take us off the board,” Wachter told Fox News Digital. “They want me to stop public comments and stop them from speaking.”

Wachter added that trans students were not directly named at board meetings and that conversations were based solely on students’ feelings and concerns.

James wrote that school board members can be removed when “they willfully neglect their duty or violate the legal protections of students in their district,” adding that the state’s Dignity for All Students Act (DASA) prohibits harassment and bullying.

However, Southeastern Legal Foundation attorney Kim Hermann has a reminder for Letitia. There’s something called the First Amendment:

“The First Amendment here is true, and so whether you have these state laws or not, a state cannot come in and just erase the First Amendment from the Constitution,” Hermann said. “Whether or not the statements and discussions about transgender and these various policies violate state laws are absolutely irrelevant to what we’re talking about in this lawsuit.

James has proven time and time again that she is a partisan bully who will politicize her powers and use her position to “get” people she doesn’t like. Let’s hope this lawsuit carries weight.
