Oregon Judge Issues Second TRO on Trump’s National Guard Deployment – RedState


Okay, we have in a way seen this coming: the judge of the district court of Oregon, Karin Immergut, now made a second temporary ban (TRO) for the deployment of troops of the Trump administration in Oregon – this covering all the troops of the National Guard, not just Oregon.
The first TRO was published Friday evening after Oregon state brought an action against the administration to challenge its deployment of 200 troops of the National Guard in Portland, Oregon. The HIC, however, was that it applied only to members of the Oregon National Guard. Thus, the Trump administration pivoted and prepared to deploy the troops of the California National Guard instead.

However, as indicated in the update of our reports on California’s maneuver, Oregon modified its complaint and asked for a second TRO “to prohibit the relocation or deployment of any national guard under the command of defendants (i.e. title 10) in the state of Oregon.”
The court set a hearing on the second Tro for 7:00 p.m. (Pacific) on Sunday evening, after which, Judge Immerture issued his order granting this Tro.
This, fundamentally, simply referring to the original Tro in terms of justification and provided that:
Defenders are temporarily prohibited from deploying federalized members of the Oregon National Guard.
The TRO is expected to expire in 14 days, with any request for preliminary injunction due to October 17, and an audience on such a request and trial on the substance now fixed for October 29.
The court rejected the request of the TRO suspension administration to grant an appeal. The administration has already called on the first Tro at the 9th circuit, so we can expect them to be on this second.
For those who wonder, the 9th circuit launched an appeal pending in the first iteration of the California / Gavin Newsom challenge to the deployment of national guard troops in California and an administrative stay in the second round of this case (involving Posse Comitatus). There is therefore a good indication that they can do the same with this case. We will see soon.
