Prosecutors seeking long prison term for Sean “Diddy” Combs and opposing bail
new York – Prosecutors said they are now expecting a Musical Sean “DIDDY” Combs could face a prison sentence “Significantly higher” than the four to five years old, they once thought that he was likely to face after his conviction for two accusations related to prostitution.
They made the observation Thursday evening in a written submission of the Federal Court of Manhattan in which they also opposed the request of Combs this week on bail of $ 50 million while waiting for a conviction of October 3.
At the beginning of July, Combs, 55, was Acquitted of conspiracy in racketeering and sex trafficking with potential perpetuity prison mandates but was sentenced of two transport managers to engage in prostitution to organize friends and male sex workers to travel to engage in sexual meetings that he filmed.
Each prostitution accusation has a maximum potential of 10 years in prison.
The prosecutors said after the verdict that they thought that federal directives on determining the sentence intended to prevent large disparities in convictions for the same crimes would likely require a prison sentence of four to five years. But they said Thursday that they thought that the range of guidelines “will be considerably higher”, increasing the risk bands fleeing.
Judge Arun Subramanian will have great latitude in determining a sentence and can choose to ignore the directives, which are not compulsory. Combs lawyers said they thought the guidelines, if they are properly calculated, will demand 21 to 27 months in prison.
On Verdict dayProsecutors won a bond after defense lawyer Marc Agnifilo argued that Combs should be released immediately on bail.
Subramanian denied the defense request, saying that Combs had not encountered the burden of showing by clear and convincing evidence a “lack of danger for anyone or the community”. But he said that Agnifilo could renew the request.
In doing so on Tuesday, Agnifilo quoted other cases which, according to him, were comparable to the conviction of Combs in which the defendants were caused by the deposit. And he cited severe conditions at the metropolitan detention center in Brooklyn, where Combs has been taking place since his arrest in September in a New York hotel.
He also said that Combs was unjustly treated to engage in a “swinged” lifestyle in which he and his friends sometimes invited male sex workers to join them in several days of marathon sexual performance.
The prosecutors said in their file on Thursday that the condemnation of Combs on the charges linked to prostitution required a compulsory requirement that he remains in prison before the conviction, unless he could prove exceptional circumstances, which, according to them.
They said that he should also stay in prison in danger for the community, an agnifilo assertion disputed in his papers.
“Sean Combs will not be violent towards anyone. As we said in court, this jury returned his life to him, and he will not waste his second chance of life, and he would do nothing to compromise his seven children having no father, and four of his children would have no parent at all,” wrote Agnifilo earlier this week.
The prosecutors also said that the conditions for federal locking had improved considerably before combat arrest. A federal judge in January 2024 had castigated conditions in prison, including his vast locking and inadequate medical care.
The prosecutors said that the affairs cited by Agnifilo in which other accused had received a deposit were not comparable to the crimes that Combs was found guilty of achievement, in particular because of his propensity for violence.
“The vast history of the accused’s violence – and his attempt continues to minimize his recent violent conduct – demonstrates his danger and that he is not modifiable in supervision,” they wrote. “The accused absolutely fails to establish clear and convincing evidence, as required, that he does not represent a danger to the community.”
