Supreme Court Gives Green Light On Mississippi Social Media Age Verification Law For Now

On Thursday, the Supreme Court allowed Mississippi to enforce its law forcing social media platforms to check the age of users.

In a brief order without dissent noted, the judges refused a request for Netchoice, a group of the technological industry representing companies like Google and Meta, to block the application of the law while the disputes continue.

Judge Brett Kavanaugh noted that the Mississippi law “is probably unconstitutional” but explained that Netchoice had “not demonstrated that the balance of misdeeds and actions promotes it at that time”. (Related: the Supreme Court confirms the law of verification of the age of Texas porn)

“To be clear, Netchoice has, in my opinion, demonstrated that it is likely to succeed in merits-namely that the application of the Mississippi law would probably violate the rights of the first amendment of its members under the previous ones of this Court,” he wrote in a brief competing opinion.

A judge of the district court blocked the Mississippi law, which the governor signed in April 2024, to take effect in July 2024. The fifth Circuit Court of Apéals canceled the decision.

“The law obliges the platforms covered to take” commercially reasonable “actions to verify the age of a user, obtain the consent of parents for users of children and adopt a strategy to alleviate damage to children inflicted on these platforms – sexual traffic, physical violence, suicide incentive, and even more”, wrote the Pispipi Lynn Fitch court.

The co -director of the Netchoice litigation center, Paul Taske, said it was “a delay in unhappy procedure” in a statement.

“Although we are disappointed with the Court’s decision, the agreement of judge Kavanaugh clearly indicates that Netchoice will finally succeed in defending the first amendment-not just in this case, but in all the proceedings in matters of Netchoice’s identification,” he said.
