Sargent: Just to conclude, the judge also issued a strong denunciation of Trump that I would like to quote: “It is a nation of constitutional law, no martial law.” AG, that’s what’s at stake here, I think. Do you expect it to go to the Supreme Court and how do you predict that the Supreme Court will manage the underlying questions?

Rayfield: You know, the optimist in me says, Hey, there is nothing to do here, And the Supreme Court will remain there and say, Hey, the lower judge has understood. And I really believe that the lower court judge did things well. It is very thoughtful, was in weeds, understands what is at stake.

I think the Supreme Court – even if it makes them – will understand what is at stake here in America. And again, sometimes even having the rule of the Supreme Court in our favor could be what this country must see to really know that even this conservative court – even a judge appointed by Trump – considers him differently.

We should not need this in society right now, but because we are so polarized, because we have politicians on both sides who continue to push polarization, it is difficult for people to really know who to trust. So having some of these validators – having a judge who is more conservative, appointed by Trump, reign in favor and speak, not only philosophically but practically, what our democracy means – is incredibly important at the moment at these moments. I just want more people to listen to.
