The DoJ has already sent requests to 16 states led by the Republicans and at least 17 States or Swing States led by Democrats, notably in Pennsylvania, Nevada, New York and Wisconsin. Some states, such as Northern Carolina, have been approached by the DoJ and DHS with an offer of use simply the Federal Backup Database to execute their list of voters.
But such a request for personal information may not be legal, according to Justin Levitt, former head of the Ministry of Justice and expert in electoral law at the Faculty of Law of Loyola Marymount University. He said it could potentially violate the 1974 privacy law, which forces agencies to pay attention to their processing of sensitive information.
Throughout the country, democratic and republican leaders have refused to hand over information. California’s secretary of state, Shirley Weber said that his office was “not forced to follow” Trump’s efforts to “conscript states to make priorities of non -statutory policy of the president”. Al Schmidt, Republican Secretary of Pennsylvania Commonwealth, said requests “represent a worrying attempt to expand the role of federal government in the electoral process of our country.”
