Trump Reveals the Administration’s Path Forward After SCOTUS Scraps Tariffs – RedState


Finally, as RedState wrote earlier Friday, the U.S. Supreme Court issued a ruling on the Trump administration’s use of emergency powers to implement its tariff policy:
On Friday, the Supreme Court issued its decision in Learning Resources, Inc. v. Trump and Trump v. VOS Selections, Inc., holding that the International Emergency Economic Powers Act (IEEPA) does not authorize the president to impose the tariffs. Chief Justice John Roberts issued the decision 6-3, with Justices Clarence Thomas, Samuel Alito, and Brett Kavanaugh dissenting (although there were also some concurring comments).
Then, in the afternoon, as my colleague Ward Clark explained, President Trump gave a press conference at the White House in response to SCOTUS’ removal of the tariffs. As part of his remarks and in a post on his Truth Social account, Trump outlined some “alternatives”—that is, the tools the administration still has to continue raising tariffs.
Among the options he mentioned were parts of some existing laws, and hinted that he would “sign an order later today to impose a 10 percent global tariff on top of our already applied tariffs… We are also launching several investigations, 301 and others, to protect our country from unfair trade practices by other countries and companies.”

It’s now official, with the White House releasing the text of a new proclamation signed by the president, in which he “invokes[es] its power, under section 122 of the Trade Act 1974, to impose customs duties of 10 percent, from February 24, for 150 days.
Trump also signed a separate executive order that “reaffirms and maintains the suspension of de minimis duty-free treatment for low-value shipments, including goods shipped via the international postal system, which will also be subject to temporary import duties imposed under Section 122.”
In an additional action, according to the White House, “the President directed the Office of the United States Trade Representative to use its authority under Section 301 to investigate certain unreasonable and discriminatory acts, policies, and practices that burden or restrict U.S. commerce.”

It is a great honor for me to have just signed, from the Oval Office, a global tariff of 10% on all countries, which will take effect almost immediately. Thank you for your attention to this matter! PRESIDENT DONALD J. TRUMP
The president also had more thoughts on the decision in a discussion thread. He first writes:
“The members of the Supreme Court who voted against our very acceptable and appropriate method of TARIFFS should be ashamed of themselves. Their decision was ridiculous, but now the adjustment process begins and we will do everything possible to make even more money than before!”
