US judge rejects lawsuit challenge to SpaceX launch site over risks to wildlife | SpaceX

A judge of the American district court rejected on Monday a prosecution by conservation groups contesting the approval of the Federal Aviation Administration in 2022 of the extended operations of launch of Roquettes by SpaceX of Elon Musk alongside a national wildlife refuge in southern Texas.

The groups have said that noise, light pollution, construction and road traffic also degrade the area, which houses oak and jaguarundis endangered, as well as nesting sites for Kemp Ridley sea turtles in danger and for threatened ribs. American district judge Carl Nichols in Washington said that FAA had satisfied its obligation “to carefully look at the effects of light on the nearby fauna”.

Donald Trump signed a decree on August 13 – entitled Activation of competition in the commercial space industry – which would relax the environmental rules for commercial space vessels, apparently benefiting from Elon Musk. Companies may be able to give up environmental examinations required under the National Environmental Policy Act (NEPA).

Private space companies must obtain the launch permits of the Federal Aviation Administration (FAA). And, as part of this process, companies are subject to the exam under the NEPA.

These environmental examinations are necessary because rocket launches and landings can be extremely disruptive for local cities and residents, as well as the natural environment. The exhaust, plumes of smoke and sound booms created at launch can injure and kill the endangered species, and the detritus of the explosion parts of rockets returning to earth can harm fish and marine animals with spills of dangerous materials, fuel slights and falling objects.

Trump said it was imperative for national security that the private rocket ship industry was launched “significantly” by 2030.

SpaceX sought to increase its rocket launches and landings across the country, even though it was involved in the trial brought by environmental groups for violating the national law on environmental policy. The groups say that the FAA has not carried out an environmental evaluation sufficiently in -depth of the impact of SpaceX on endangered species concerning its rocket launches in Boca Chica, Texas.

The trial examined the first launch of Massive Starship Rocket of SpaceX in Texas in April 2023.
