Federal Judge Rules Trump Deploying Troops To Portland Unconstitutional

A federal judge has permanently blocked President Trump’s deployment of National Guard troops to Portland, Oregon, ruling that the move violated the Constitution.
U.S. District Judge Karin Immergut issued a 106-page ruling Friday barring Defense Secretary Pete Hegseth from sending members of the federalized Guard from Oregon, Texas and California to Portland. The Trump appointee said the deployment exceeded presidential authority and violated the 10th Amendment.
The ruling follows a three-day trial to determine whether protests outside Portland’s Immigration and Customs Enforcement building warranted military intervention under federal law. The Trump administration has argued the troops are needed to protect federal personnel and assets, Fox News reported.

“The evidence demonstrates that these deployments, which were opposed by the Governor of Oregon and were not requested by federal officials charged with protecting the ICE building, exceeded the President’s authority,” she wrote.
The judge said Trump failed to prove the existence of a rebellion requiring military force. She added that Oregon’s governor opposed the deployment and that federal officials responsible for the ICE building never requested troops.
“Even with great deference to the president’s determination, he had no legal basis to federalize the National Guard,” Immergut said.
The ruling cited the 10th Amendment, “which ‘reserves to the states’ all powers not expressly delegated to the federal government in the Constitution.” »
Portland and Oregon sued the administration in September after Hegseth sent 200 troops to the city. The judge temporarily blocked the deployment on Sunday before making it permanent on Friday.
The administration can appeal the decision. Trump also faces a temporary injunction blocking troop deployment to Chicago.
