Gunman Opened Fire Near VP Motorcade on National Mall

We have additional information regarding the man shot and killed by Secret Service agents on the National Mall Monday afternoon. The man was previously identified as Michael Marx, 45, of Texas.
Now, according to U.S. Attorney for the District of Columbia Jeannine Pirro, Marx has been charged with three federal crimes.
As RedState previously reported, Marx was shot and killed by Secret Service agents near 15th Street and Independence Avenue in Washington, D.C., about four blocks south of the White House, after he opened fire in the face of the agents. He was taken into custody and transported to hospital so his injuries were not life-threatening.

On Wednesday, Pirro’s office accused Marx, via a complaint, of the following violations:
- 18 USC § 111(a)(1) and (b) (Assault, resistance, obstruction of certain officers using a dangerous weapon)
- 18 USC § 924(c)(1)(A)(iii) (Use, carry, possession, brandishing and discharge of a firearm during a crime of violence)
- 18 USC § 922(g)(1) (Unlawful possession of a firearm and ammunition by a person convicted of a felony punishable by imprisonment for more than one year)
Along with his office’s announcement, Pirro explained what federal prosecutors intend to prove in the case against Marx.

We will prove that this defendant carried an illegal firearm into the heart of Washington, DC, opened fire on Secret Service agents near a crowded intersection, and shot an innocent bystander who was simply crossing the street with his family. My office will bring the most serious charges available against anyone who brings gun violence to our streets, especially when that violence takes place just steps from the seat of our government and the path of the Vice President of the United States.
The affidavit filed in support of the complaint sheds additional light on the matter, as does the announcement from the U.S. Attorney’s Office.
According to court documents, on May 4, 2026, at approximately 3:40 p.m., a plainclothes U.S. Secret Service agent observed a man, later identified as Marx, appearing to conceal a firearm on the right side of his body near 15th Street and Madison Drive NW. The agent alerted the Secret Service Joint Operations Center and requested uniformed backup.
At the same time, Vice President JD Vance’s motorcade left the White House, passing through the area of 15th Street and Independence Avenue SW.
Uniformed Secret Service agents responded and located Marx along the path of the vice president’s motorcade. As the police approached, Marx walked toward a group of civilians crossing the street.
The officers gave verbal orders. Marx fled east on Independence Avenue SW. As officers chased him, Marx pulled a gun from his waistband as he ran across the crosswalk toward onlookers.
When Marx reached the sidewalk, he turned and shot one of the pursuing officers. A civilian witness who was standing behind the police officer was injured in the leg. The officers returned fire, striking Marx in the hand, left arm and upper abdomen.
When asked Tuesday night if this was politically motivated, Pirro noted that one of the things Marx said on the way to the hospital was “F— the White House” and “Kill me, kill me, kill me.”

The incident came just over a week after an assassination attempt on the president and members of his cabinet at the White House Correspondents’ Association dinner. Cole Allen was federally charged in connection with the incident.
Like Allen, Marx’s case is currently before Magistrate Judge Zia Faruqui, whose apology to Allen earlier in the week regarding conditions in the Washington, D.C. jail angered many. But like Allen’s, Marx’s case will soon be presented to a grand jury for a formal indictment. And, fortunately, the person shot by this attacker – a 15-year-old innocent bystander – is expected to recover, as is the Secret Service agent shot by Allen.

Regardless, the charges against Marx are serious, carrying maximum sentences of 20 years, life in prison, and 10 years, respectively.
