Huge Win for Trump Administration As DC Circuit Court of Appeals Tosses Boasberg Contempt Order – RedState


The Trump administration has just marked another great legal victory. Friday, the DC Circuit Court of Appeals made a prescription in the JGG c. Trump The case which cancels the ordinance of judge James Boasberg concluding a probable cause to keep the administration in contempt.

Margot Cleveland’s thread does a good job to put it in place, but here is the story of the rear:
In March, judge Boasberg made a temporary ban order effectively obliging the administration to transform the plans of illegal foreigners (members of Tren de Aragua, to this) who were on the way to El Salvador. When the administration has not respected this (for many reasons, both legally and practically), Boasberg later found a probable cause to hold the administration in contempt.
Here is what Streiff had to say about it at the time:
If you needed an example of an arrogant and authoritarian liberal judge, judge James Boasberg is your man. He tried to rewrite the federal law to give himself jurisdiction in a case that had no attachment to his district and ignored the requirement of the black letter that the expulsion affairs go through an appeal to the Corpus of Habeas before heading to the Federal District Court. In what can only be called a “untimely” decision, you can almost see the spitting stains on the document. He warns the government that if the Ministry of Justice refuses to prosecute the case, he will appoint a personal prosecutor to do so. “If the government” refuses “or” the interest of justice requires “, the court” will name another lawyer to continue contempt “.” No one knows how it works; More importantly, the administration is sure that this is not the case. “The district courts cannot outsource the power to prosecute the private people,” said the administration in its response, “isolates them from the control of executive branches, then unleashes them against the executive power.”

The administration, of course, called on this conclusion, and now the DC Circuit Court of Appeals has agreed, granting the Mandamus report in short and canceling the order of Boasberg judge on April 16, 2025.
The opinion by the Court of Curiam itself is brief, but there are concordant and dissident opinions, so the whole decision lasts 110 pages. Here is the knot, however:
Judge Katsas and Judge Rao conclude that the government has satisfied the strict requirements for a brief from Mandamus. The court therefore grants the government’s request for Mandamus and leaves the probable order of the district court. The Pillard judge extends from the granting of Mandamus and the Vacatur.

The district court used the threat of criminal outrage to force the executive power to comply with an order that it did not have the power to enforce. And he oriented this constraint towards the exercise by the exercise of his power of foreign affairs. The importance of the error of the district court, associated with the potential for abuse in future cases, justifies our intervention at this stage of the procedure. Given the “totality of circumstances”, the brief is appropriate.
It is therefore a good surprise / development of Friday for administration. Maybe not so much for judge Boasberg.
