A New York City Board of Elections employee said it was not his role to report anyone when asked about the handling of non-citizen registrations, according to hidden video footage.

According to an undercover video captured by Muckraker, in which its reporter attempted to pose as a non-citizen, a worker said he would process requests from non-citizens.

“Every once in a while…people come here…and they check in, they weren’t citizens,” the employee told the reporter.

When the journalist told the worker that he had a Canadian green card, he was told that he had to become a citizen.

“I wouldn’t fill it,” the worker said. “You have to be a citizen to fill it out.”

“We cannot stop you from submitting your application,” he added, warning that people have found themselves in “legal situations” in which non-citizens have attempted to register.

When the reporter responded that he really wanted to sign up, the worker reiterated that it was up to him whether he wanted to fill out an application.

“I can’t tell you what to do. If you want to fill it out, fill it out. But it’s all clearly marked, especially at the bottom. It says American citizen. So I’m warning you, if you fill this out, and you’re not [a citizen]. If it comes to you, it comes to you. If it doesn’t, it doesn’t,” the worker said, again appearing to warn the reporter of the legal consequences.

“But we accept everything that comes over the counter,” he continued.

When asked if he would report him if he made a request, the worker said he would not report anyone.

“It is not my role to denounce anyone,” he said. “My job is just to get the application and submit it to the department.”

In New York, it is illegal for non-citizens to register to vote. A previous measure to allow non-citizens to vote in local municipal elections in New York was ruled unconstitutional last year.
