RNC sues over out-of-state voters’ ability to cast ballots in Virginia elections

The Republican National Committee filed a lawsuit Monday challenging Virginia’s election system, claiming the state allows some people who have never been physical residents to vote in its elections.

If the parents resided in Virginia and then moved overseas, they are allowed to remain legal voters. But Virginia law also covers their children, who may never have lived in the state but derive their domicile by proxy from their parents’ last U.S. address, the RNC said.

This means that adults who have never been domiciled in the state can still vote in its elections.

“Voting by individuals who are not and have never been residents of Virginia dilutes the votes of qualified Virginia voters, undermines the integrity of Virginia’s electoral process, and inflicts concrete harm on political parties that participate in Virginia elections,” the RNC said in the lawsuit filed in a state circuit court in Richmond.

He was joined by Matthew Hurtt, head of the Arlington County Republican Executive Committee and the Restoring Integrity and Confidence in Elections political action committee.

They said the overseas policy was not required by federal law and was contrary to the state Constitution.

The Virginia Department of Elections declined to comment.
