Supreme Court Will Hear Arguments on Crucial Case Wednesday — and Trump Says He Will Be There – RedState

The Supreme Court is expected to take up the birthright case Wednesday morning, and President Donald Trump said Tuesday from the Oval Office that he would be there to listen to oral arguments.





“I’m going,” he told reporters, “because I’ve been listening to this argument for so long.”

White House Press Secretary Karoline Leavitt confirmed later Tuesday that she did indeed plan to be present as the justices heard arguments on the constitutionality of an executive order he signed on the first day he returned to office in January 2025. Called “Protecting the Meaning and Value of American Citizenship,” the order sought to end birthright citizenship for children born in the United States without at least one parent who is a citizen or legal resident permanent.

Of course, the lawsuits immediately arose, and lower courts predictably ruled that his order was unconstitutional. Trump argues that birthright has long been misunderstood and that its use today is not at all what the authors of the 14th The amendment, which codified the birthright of citizenship, had in mind.





“…I’m going,” Trump said when a reporter brought up the matter.

The president said he was there “because I’ve been listening to this argument for so long.”

“And it’s not about Chinese billionaires who are billionaires from other countries and all of a sudden have 75 children, or 59 children in one case, or 10 children, becoming American citizens,” Trump argued. “They were slaves.”

Birthright citizenship was established by the 14th Amendment, which was ratified in 1868 to guarantee citizenship to recently freed slaves – but has historically applied to anyone born in the United States or its territories.

Historians say there is no record of a sitting president ever attending a SCOTUS hearing.

Many left-wing experts accuse the president of trying to circumvent the concept of separation of powers by using executive power to intimidate the judiciary. Civil Rights Division Assistant Attorney General Harmeet Dhillon has a message for them: Cool your jets.





Trump had said he “might” attend a SCOTUS hearing on tariffs in November 2025, but ultimately did not. It would certainly be something for the history books if he did it this time around. I just hope for his sake that he doesn’t have to listen to one of Justice Ketanji Brown Jackson’s rants, which are beginning to become legendary even among his fellow jurists due to their length and bizarre interpretations of the law.
