President Donald Trump said on Friday that anyone burns the American flag “will be immediately arrested” and risks a one -year prison sentence, citing his decree of August 25 on the desecration of the flag.

“At the ice, at the border patrol, the police and all the American soldiers: according to my decree of August 25, 2025, please inform yourself that, from that moment, anyone burns the American flag will be subject to a year in prison,” Trump published on social Friday.

“You will be immediately arrested. Thank you for your attention to this case!”

The decree itself has ceased to create new sanctions, ordering the Ministry of Justice to prioritize affairs under existing laws “to the maximum extent authorized by the Constitution”.

Decisions of the Supreme Court in Texas c. Johnson (1989) and United States v. Eichman (1990) judged that the burning of the flag is a protected discourse. Trump’s statement goes further, setting up potential legal battles if arrests are prosecuted.
